Our client is looking for a Contracts Manager to work on the North-South Commuter Railway (NSCR) Project (Malolos - Tutuban) (NSCR-N1 Project) in the Philippines.
They are looking for a Civil Works FIDIC contract specialist with commercial/legal background, including Quantum and Delay/Extension of Time conducting forensic investigations, analyzing documentation, and providing expert opinions and reports on Variations and Contractors' claims; twenty (20) plus years in construction with ten (10) years longitudinal Infrastructure, preferably including a minimum of five (5) years in Railway projects.
Position Duties and Responsibilities:
  • A senior contract specialist with specific expertise for evaluation and settlement of Claims and              Variations, to augment the current Contracts Team; 
  • Interpreting Contracts, forensic investigation and analysis of Civil Works Contractor's Claims for           extension of Time for Completion, and additional costs; 
  • Delay analysis to establish Excusable and Non-Excusable delays (Concurrent delays), liaising with       the Technical and Schedule Teams;
  • Liaising with Cost Team to establish Variation Order costs and Contractors' Claims for time related       additional costs;
  • Liaising with local Contract Administrators and Technical Teams to understand Philippine Laws,             Codes, Regulations and industry practices;
  • Preparation of reports on Contractor's Claims, and preparing other contractual documentation; 
  • Collaborating, liaising/coordinating as necessary with the Employer's Project Management                   Organization (DOTr-PMO) and conducting PowerPoint presentations as may be required;
  • Monitoring incoming and outgoing correspondence and implementing required actions based on           Change & Claims Logs, particularly with respect to the Engineer's response time obligations;
  • Advising on Contractors' contractual Interface obligations;
  • Consulting with the Employer and Contractors and preparing determinations;
  • Assisting with Dispute Board proceedings ("Standing' and "Ad-hoc' DBs), including review of                 Contractor's Position Papers, Referrals, and assisting with preparation of Employer's Position               Papers and Rejoinders, attending Hearings and preparing Post-Hearing Statements.

 
Job Requirements

 

  • Bachelor Degree (BSc); and/or Higher National Certificate/Diploma (HNC/HND) in job related                 subjects. 
  • Preferably formal qualification/accreditation in FIDIC Red/MDB Pink Book Forms,                                    mediation/arbitration e.g. CIArb, with Dispute Board membership experience being an advantage.
  • twenty (20) plus years in construction with ten (10) years longitudinal Infrastructure, preferably                including a minimum of five (5) years in Railway projects.
