Our client is seeking a Commercial Advisor (Claims and Risk) to support their activities on Passenger Rolling Stock and Signalling projects in Brisbane, Australia. The Commercial Advisor (Claims and Risk) is required to strengthen the program's management of contractor delay notices, EOTs and cost claims under the Design, Build, Maintain (DBM) contract. This specialised capability is required to ensure timely, well-substantiated and contractually robust responses, with clear assessment of entitlement, causation and quantum to protect the client's position.
 
The role will also provide proactive commercial advice to identify and mitigate emerging time and cost risks, working across delivery, planning and interface teams. This will support reduced liability exposure, minimise dispute risk and improve overall commercial outcomes for the program.

The key responsibilities of the Commercial Advisor (Claims and Risk) will include:
Claims and Delay Management
• Support the assessment and coordination of responses to contractor notices, including Notices of Delay, EOT claims and cost claims
• Establish and maintain contemporaneous records and positions to support the client's contractual stance
• Support claims analysis for entitlement, causation and quantum, coordinating inputs from planning, technical and delivery teams
• Drive timely, robust and defensible responses in accordance with contractual timeframes

Liability and Risk Management
• Proactively identify and manage the client's liability exposure arising from design development, interfaces, access, stakeholder constraints and program decisions
• Provide forward-looking commercial advice to mitigate potential claims before they crystallise
• Support the development of commercial strategies to manage and reduce exposure, including negotiation positions and risk allocation approaches

Commercial Strategy and Issue Resolution
• Support the resolution of complex commercial issues that sit outside business-as-usual contract administration
• Assist in the development of position papers, commercial briefings and escalation materials for senior stakeholders

Cross-Team Integration
• Work closely with planning, engineering, interface and delivery teams to ensure alignment between program outcomes and contractual positions
• Ensure commercial implications of delivery decisions are understood early and managed proactively
 
Please Note: Ad hoc visits to sites in Torbanlea and Ormeau will be required. Assume one (1) per month to Ormeau and one (1) per every three (3) months to Torbanlea.

 
Job Requirements

 

The Key Personnel offered by the Supplier must have:
a) Bachelor's degree in business, Law, Engineering or a related field
b) A minimum of five (5) years of experience providing commercial advice to government on the delivery of major rail projects in Australia, with two (2) years being on a major rollingstock delivery project.
c) Availability to commence full time on the State Contract Date.
 
Start Contract Date: 3 August 2026
End Contract Date: 31 December 2027
Extension options: 1 x 12-month extension option at client's discretion
